Resale properties are often where the real value lies in Gurgaon’s market — established societies, known maintenance culture, no delivery risk. But the resale process has hidden complexities that can turn a good deal into a nightmare. Here is what I tell every client before they buy resale.
Title Verification is Non-Negotiable
Before you pay a token amount, verify the title. This means checking the chain of ownership, ensuring the property is not subject to any dispute, mortgage, or encumbrance, and confirming that the seller has clear right to sell. In Gurgaon’s older sectors, you will encounter properties with ownership disputes, builder dues, or missing documents. A property lawyer’s title opinion is Rs 5,000 to Rs 15,000 well spent.
Builder and Society Dues
Many resale sellers carry outstanding dues — unpaid maintenance, builder arrears, or unpaid property tax. These dues can transfer to you if not cleared at the time of purchase. Always ask for a No Dues Certificate from the RWA and the builder before finalising any resale deal.
Occupation Certificate and Completion Certificate
In Gurgaon, many properties — including some in premium societies — were sold and occupied before receiving the Occupation Certificate from DTCP Haryana. Buying a property without an OC can create complications in home loan sanction, utility connections, and future resale. Always confirm whether the OC has been issued.
The Society NOC Process
Most housing societies in Gurgaon require a No Objection Certificate from the RWA before a resale transfer can proceed. The NOC process typically takes 15 to 30 days and requires the seller to clear all dues. Factor this timeline into your transaction planning — a delayed NOC can push back your registration date.
Stamp Duty and Registration Costs
In Haryana, stamp duty for women buyers is 5 percent and for men is 7 percent of the registered value. Registration charges are 50 percent of the stamp duty. On a Rs 1 crore property, a male buyer pays approximately Rs 7 lakh in stamp duty plus Rs 3.5 lakh in registration — Rs 10.5 lakh total. This is often underestimated in buyer budgets.
Final Thoughts
Resale buying in Gurgaon rewards the patient, diligent buyer. The risks are manageable if you know where to look. My advice: never skip title verification, always get the No Dues Certificate, and budget accurately for stamp duty and registration. These are not optional steps — they are the difference between a clean purchase and years of legal trouble.
